Boxing Aficionado Terms and Conditions of Use

Introduction These Terms and Conditions of Use ("Terms") govern your use of the Boxing Aficionado website, APIs, and related services (collectively, the "Service"). This includes viewing, exploring, and creating NFTs, and using our tools to connect directly with others to purchase, sell, or transfer NFTs on public blockchains. “NFT” in these Terms means a non-fungible token or similar digital item implemented on a blockchain, such as Ethereum, which uses smart contracts to link to or otherwise associate with certain content or data.
Acceptance of Terms By using the Service, you agree to these Terms. If you use the Service on behalf of a company or entity, you represent that you are authorized to bind that entity to these Terms.
Important Information These Terms include a mandatory arbitration agreement and class action waiver in Section 17. By clicking to accept and/or using our Service, you agree to these Terms. If you do not agree, you may not use the Service.
Service Description Boxing Aficionado is a web3 service allowing users to discover and interact with NFTs on public blockchains. We do not have custody or control over the blockchains you interact with. You may need a third-party wallet to use our Service.
Additional Terms Additional terms may apply to specific services and become part of your agreement with us if you use those services. In the event of a conflict, the additional terms will control.
Changes to Terms Boxing Aficionado may modify these Terms at any time. Material changes will be communicated through the Service or by updating the “Last Revised” date. Continued use of the Service constitutes acceptance of the revised Terms.
Access and Security You are responsible for the security of your wallet and account. Notify us immediately if you suspect any security issues. You must comply with all applicable laws when using the Service.
Eligibility Users must be at least 18 years old. Users between 13 and 18 years old may use the Service only through a parent or guardian’s account.
Ownership and Intellectual Property The Service, including its look and feel and all related content, is the property of Boxing Aficionado or its licensors. You may not use our intellectual property without permission.
License We grant you a limited, non-exclusive, non-transferable license to access and use the Service, subject to compliance with these Terms.
Third-Party Content Boxing Aficionado does not make representations about third-party content visible through our Service. Verify the legitimacy of NFTs from third-party sellers.
User Conduct You agree not to engage in prohibited activities such as using the Service for illegal purposes, spamming, or infringing on the intellectual property rights of others.
Indemnification You agree to indemnify Boxing Aficionado for any claims arising from your use of the Service or violation of these Terms.
Disclaimers The Service is provided "as is" without warranties of any kind. We do not guarantee the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
Assumption of Risk You accept the risks associated with NFTs, including volatility and regulatory uncertainty.
Limitation of Liability Boxing Aficionado’s liability is limited to the maximum extent permitted by law. We are not liable for any indirect, incidental, or consequential damages.
Dispute Resolution Any disputes will be resolved through binding arbitration, except for small claims and intellectual property disputes. You waive any right to a jury trial or to participate in a class action.
Governing Law These Terms are governed by the laws of the State of New York. Any disputes not subject to arbitration will be resolved in Queens County, New York.
Termination Boxing Aficionado may terminate your access to the Service at any time without notice.
Severability If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
Miscellaneous These Terms constitute the entire agreement between you and Boxing Aficionado regarding the Service. They may not be transferred or assigned by you without our consent.
